Subject: 9642/Amend 9623/1991-175 HCA Parkridge Date: Mon, 4 Jun 1990 17:11:00 -0500 ORDINANCE NO. 9642 AN ORDINANCE TO AMEND THE ORDINANCE NO. 9623, ENCAPTIONED AS SET FORTH HEREIN, SO AS TO DELETE THE CAPTION IN ITS ENTIRETY AND SUBSTITUTE NEW LANGUAGE IN LIEU THEREOF AS SET FORTH HEREIN BELOW. ______________________________ WHEREAS, there was an inadvertent error in Ordinance No. 9623 in the address of the property to be rezoned; NOW, THEREFORE, SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 9623 encaptioned as, "AN ORDINANCE TO AMEND ORDINANCE 6958, AS AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS TO REZONE A TRACT OF LAND LOCATED AT 2333 MCCALLIE AVENUE, BEING OFF THE NORTHEAST LINE OF MCCALLIE AVENUE AT LYERLY STREET, AND A TRACT OF LAND LOCATED AT 161 LYERLY STREET BEING ON THE NORTHWEST LINE OF LYERLY STREET AT VINE STREET FROM R-2 RESIDENTIAL ZONE AND R-3 RESIDENTIAL ZONE TO R-4 SPECIAL ZONE.", be deleted in its entirety and the following new language be inserted in lieu thereof: "AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS TO REZONE A TRACT OF LAND LOCATED AT 2333 MCCALLIE AVENUE, BEING OFF THE NORTHEAST LINE OF MCCALLIE AVENUE AT LYERLY STREET FROM R-2 RESIDENTIAL ZONE AND R-3 RESIDENTIAL ZONE TO R-4 SPECIAL ZONE." SECTION 2. BE IT FURTHER ORDAINED, that the first paragraph of the legal description as set forth in Ordinance No. 9623 be amended so as to delete it in its entirety and new language be inserted in lieu thereof as follows: A tract of land located at 2333 McCallie Avenue, being off the northeast line of McCallie Avenue at Lyerly Street. SECTION 3. BE IT FURTHER ORDAINED, that this Ordinance shall take effect two weeks from and after its passage, the public welfare requiring it.
